Guerlain Insolence in packaging dispute

A French court has ordered Guerlain to stop marketing Insolence in its current packaging:

Judge Claude Vallet, who deals with urgent cases at Paris’s Court of First Instance, found that the packaging by Serge Mansau, composed of three half-spheres atop each other, was too similar to a design registered by Jean-Claude Cardiet of Paris firm Cardiet Design.

Guerlain must therefore stop production of the packaging within 15 days of the judgement, dated October 20, although it has not been ordered to take existing bottles of the fragrance off the market. (via cosmeticnews)

Oops. I didn’t love the bottle anyway; it didn’t look very Guerlain-ish.

Update 11/3: As you might expect, Guerlain has filed an appeal. (via Yahoo News)

Update 12/20: Cardiet Design dropped their lawsuit.

    I'd love to see the other bottle design, to compare. Not very Guerlain-ish, as you say…and it looks like a rose while the juice smells of violets. Mind you, nicking the design may be the only insolent thing about Insolence!

    You never know! Or, they'll settle the dispute and everyone who stocked up will be left with gallons of Insolence :-)

    LOL! I have no intention of buying it. I thought it was awful.

    I do have a sample of Extrait de Songe tucked away in a drawer…

    That one has been re-released under a new name…don't think you're going to retire on your ebay earnings from the sample, unfortunately :-)
